New laws on using handheld devices while driving will come into effect from 2022 that make it illegal for drivers to use a device in nearly all circumstances.

Previously there was a legal loophole that meant drivers were able to take pictures, film, search playlists and even play some games while driving without breaking the phone use laws.

It is already illegal for drivers to call, text, or communicate on their mobile phones but anything that didn’t involve communicating on handheld devices was not against the laws relating to mobile devices though they may find themselves charged with dangerous driving.

The new rules will now explicitly ban drivers from using a device to take photos, play games or searching for their next song and rule breakers will face a £200 fine and six points on their driving licence.

This will include drivers using the devices for these activities when stopped at traffic lights or caught in a traffic jam.

Drivers will be able to use hands-free devices, like a satnav or mobile phone secured in a cradle but they must still be in proper control of their vehicle and can still face punishment if the police find them not to be.

Another exemption will be in place for drivers in stationary vehicles to allow them to make contactless payments using their mobile phones, so that drivers can still do so when at restaurant and shop drive-thrus.

The Highway Code will also be updated to reflect the new rules and punishments for drivers caught using their mobile or other devices.

1. Silence notifications – most modern phones now come with a do not disturb or even driving mode that prevents notifications from flashing up on your phone while on the move. This removes the temptation of checking your phone when the notification pops up.

2. Put your phone away – if you don’t need to see your phone screen for navigation then we recommend putting it in a safe location where it is out of your reach. Again this removes the temptation for you to use the device.

3. Let your passenger control the music – if you’re travelling with a passenger then one way to remove the need for you to skip to the next track or play a different podcast is to have them control the music.

4. Have your playlist queued up – if you’re travelling alone or don’t trust you co-pilot to control the music then you can put together a playlist for the car of songs you know you’ll like and have this queued up and playing before you set off.

5. Stop in a safe location – if you really do need to use your phone then pull over at a safe location, switch the engine off and then do so.
